1. Acceptance of Terms

Welcome to Truckiyard. These Terms and Conditions (“Terms”) govern your use of the Truckiyard mobile application (“the App”) and related services (“Services”). The App is operated by M analytics solutions (“we,” “us,” “our”), a sole proprietorship located at EDATHOLA KOTTASSERI HOUSE, ERANNIPADI, KANNAMANGALAM, Malappuram – 676304, India.

By downloading, installing, accessing, or using the App, you (“User” or “you”) agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Scope of Services / Products

Truckiyard is a business management solution designed specifically for the construction material industry. The App provides tools for:

• Inventory management and tracking
• Sales order processing and monitoring
• Customer and supplier management
• Transportation logistics
• Business reporting and analytics

3. Account Registration and Eligibility

3.1. To access the App’s features, you must register for an account and provide accurate, complete, and current information.

3.2. You must be at least 18 years old and have the legal capacity to enter into binding contracts.

3.3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.4. You agree to notify us immediately of any unauthorized use of your account.

4. Pricing and Payment Terms

4.1. The App is provided on a subscription basis. By subscribing, you agree to pay all applicable fees for your chosen subscription plan.

4.2. Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your app store account settings before the renewal date.

4.3. All fees are non-refundable except as required by applicable law.

4.4. Payments are processed through secure third-party payment gateways via the Apple App Store or Google Play Store.

5. Intellectual Property Rights

5.1. The Truckiyard App, including its software, design, trademarks, logos, and all underlying technology, is owned by Mfacture Analytics Solutions Pvt Ltd and licensed to M analytics solutions for operation and distribution.

5.2. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the App for your personal or internal business purposes in accordance with these Terms.

5.3. You retain all ownership rights to the business data, content, and information you create or store using the App (“User Content”).

6. User Responsibilities

6.1. You agree not to:

• Use the App for any illegal or unauthorized purpose
• Share your account with unauthorized users
• Reverse engineer, decompile, or attempt to extract the App’s source code
• Upload or transmit any viruses, malware, or malicious code
• Interfere with or disrupt the App’s functionality or servers
• Use the App in violation of any applicable laws or regulations

6.2. You are solely responsible for maintaining independent backups of your critical business data.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.

The technical infrastructure and data security are managed by our technology provider, Mfacture Analytics Solutions Pvt Ltd.

8. Limitation of Liability

To the fullest extent permitted by law, neither M analytics solutions nor its technology provider, Mfacture Analytics Solutions Pvt Ltd, shall be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Service interruptions, downtime, or technical failures
• Damages resulting from your failure to maintain adequate data backups

9. Termination

9.1. You may terminate your account at any time through the App settings.

9.2. We may suspend or terminate your access to the App immediately if you breach these Terms, engage in illegal activities, or fail to pay subscription fees.

9.3. Upon termination, your right to use the App will cease immediately.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Malappuram, Kerala, India.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last Updated” date and posting the revised Terms in the App. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.
